Terms of Service

1. The Service

Spin & Speak helps you practice spoken English through randomly generated topics, AI-powered speech analysis and feedback, and habit-building tools like streaks and history tracking. The Service is currently in beta: features may change, and you may occasionally run into bugs. We appreciate your patience, and your feedback.

2. Eligibility

You must be at least 14 years old to use Spin & Speak. By using the Service, you confirm that you meet this requirement, or that a parent or guardian has agreed to these Terms on your behalf where applicable.

3. Your account

To save your session history and access certain features, you need to sign in with an email address or a Google account. You're responsible for keeping your account secure and for all activity under your account. Let us know right away if you suspect unauthorized access.

4. AI-generated content: please read this

Spin & Speak uses artificial intelligence (via OpenAI's models) to transcribe your speech and generate feedback, grammar corrections, level estimates, and suggestions. This feedback is meant to help you practice and improve. It's not a certified language assessment, and shouldn't be relied on as a substitute for professional language testing (like IELTS, TOEFL, or Cambridge exams) or professional teaching advice. AI-generated content can occasionally be inaccurate, including the CEFR level it estimates.

5. Your content

You keep ownership of what you say and write in the app: your recordings, transcripts, and notes. By using the Service, you grant us the license we need to process this content in order to provide the Service to you, like sending your audio to our transcription provider and storing your session history. See our Privacy Policy for details on how this data is handled.

The topics, questions, and prompts in Spin & Speak were written by us (real humans at Speedy Languages, not AI) and remain our intellectual property. You're welcome to use them for your own practice, but please don't republish or redistribute our topic database elsewhere.

6. Acceptable use

Please don't:

• Use the Service for anything illegal or harmful
• Try to disrupt, hack, or reverse-engineer the Service
• Use automated tools to scrape or extract our topic database or feedback system
• Impersonate someone else or provide false information when creating your account
• Record or upload content that's abusive, hateful, or infringes on someone else's rights

We may suspend or terminate accounts that violate these rules.

7. Beta status and no warranty

Spin & Speak is provided "as is" and "as available," without warranties of any kind, express or implied. Because the Service is in active development, features, scores, and feedback may change, and we don't guarantee the Service will be uninterrupted, error-free, or available at all times.

8. Limitation of liability

To the fullest extent permitted by law, Speedy Languages won't be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated feedback or level assessments. Our total liability for any claim relating to the Service is limited to the amount you've paid us in the past 12 months, which for a free service is zero.

9. Third-party services

The Service relies on third-party providers, including OpenAI (for transcription, analysis, and text-to-speech), Supabase (for hosting and authentication), PostHog (for product analytics and session replay; see our Privacy Policy for details on what's collected and masked), and, if you choose, Google (for sign-in). Your use of these integrations is also subject to those providers' own terms.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where reasonably possible.

11. Changes to these Terms

We may update these Terms as the Service evolves. If we make material changes, we'll do our best to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles, without prejudice to any mandatory consumer protection laws that apply in your country of residence.
